While the Bill is framed as a response to youth crime, SACOSS argues that it disproportionately impacts children and young people, applying adult-oriented penalties to those as young as 10. The submission critiques the lack of procedural fairness, vague definitions that invite racial profiling, and the potential to criminalise free association. SACOSS calls for the Bill to be discontinued, advocating instead for evidence-based, trauma-informed responses that address the social drivers of youth offending—such as poverty, family violence, and lack of access to support services—and that genuinely support young people’s wellbeing, development, and reintegration.
